SCOTUS and Marriage



In their announcement yesterday, The Supreme Court of the United States denied review by the Court of the 7 cases in 5 states where the appellate court upheld the striking down of Gay Marriage bans in those 5 states.  The seven petitions from five states - Utah, Oklahoma, Virginia, Indiana and Wisconsin - will now be subject to the pro-equality rulings from the 7th, 10th, and 4th Circuit Courts of Appeals, and other states within those circuits will likely also be subject to the rulings.  Committed, loving same sex couples have already begun marrying in those five states.  Marriage Equality will soon come to the other six states covered by the 7th, 10th, and 4th Circuit Courts of Appeals making 11 more states with Marriage Equality for all their citizens.  This brings the total now to 30 states with Marriage Equality out of the 50 states in our union.  


This morning the Court issued additional orders from its September 29 Conference.   Most notably, the Court denied review of all seven of the petitions arising from challenges to state bans on same-sex marriage.  This means that the lower-court decisions striking down bans in Indiana, Wisconsin, Utah, Oklahoma, and Virginia should go into effect shortly, clearing the way for same-sex marriages in those states and any other state with similar bans in those circuits.

Towleroad.com's legal beagle, Ari Ezra Waldman, has his analysis of the SCOTUS actions here and posits 'Why Each SCOTUS Justice Might Be Avoiding the Marriage Equality Question Right Now' hereThe Court did not make a substantive ruling on the constitutionality of banning gays from marrying. Nor did the Court make any ruling on the justice of marriage equality. The constitutional question lives on for another day, so the fight is not over.  However the tide has turned inevitably in favor of Equality and it is just a matter of time before we have nation wide Marriage Equality.  And it's about fucking time!
