Games People Play



In yesterday's post, I told you about the letter I received on Monday listing a judgement against me for unpaid rent at my last residence, The Hills #1040.  I also told you about my initial response email to Sandee Garrett, regional manager for Myan Properties who run The Hills.  Today I would like to recap the entire email exchange as it stands so far.

My original email:

You made the offer to let us out of our lease on apartment 1040 early because we were unhappy with the maintenance.  We kept you informed of our move date and moved when we said we would.  I was expecting a refund of our deposit in the amount of $375 as we left the premises clean and undamaged.

 I received in the mail today a notice of summary judgement for 440.81 delinquent rent and court costs from The Hills.  What is this garbage?  You wanted us to move, so we did in good faith.  This judgement is crap and you know it.  Please check with whoever did this and forthwith return my deposit.

Sandee's response was:

You did not pay your April rent.

To which I replied:

I beg to differ with you.  I did pay my April rent and on time.  The attached files show the front and back of my check 1159 listing the endorsement for deposit to the Hills account, the portion of the bank statement showing the check was paid, a screen shot of the transaction listing, and a scan of the check stub in my check book.  Perhaps someone made a clerical error.  However, in any case, there should have been no problem returning my deposit.  I want my deposit returned and the record of this legal proceeding removed from both our credit reports.  I will expect this in a timely manner or the result will be a legal proceeding of your own.  ​

Sandee replied:

I'm sorry. My mistake it was for May rent you were delinquent and still in the unit.

This was my response:

I moved on the 1st of May and turned in my keys after cleaning the apartment that same day which is the date which I notified you of our departure.  I left a forwarding address and my phone number.  Attached please find the receipt for the rental truck which I used to move from there to here.  Also attached are the relevant emails between us as to my notice of intent to vacate and the confirmation thereof.  I complied with your requests, moved on the day I said I would and returned the premises clean and undamaged on that same day.  Someone is trying to play games and it is not I.  Please correct any misunderstanding your staff may have and forthwith return my deposit.

Included in my emails was documentation proving my points and refuting her claims.  Sandee has yet to respond to my last email.  All I really want is the return of my deposit ($375) and the removal of this smirch on both Will and my credit reports.  However, if I have to retain legal counsel and return to court to get these results, it will surely cost Myan Properties a lot more than $375 to make me go away.  This is because I will bring up all the maintenance and health issues we experienced that led to her offer to release us early from our lease.  Then I will ask for restitution and punitive damages for the whole series of events including a wrongful suit, medical costs, mold exposure, improper maintenance, callous treatment and slander of our reputations.  I have documentation of everything to include letters, photographs, the Code Enforcement officer who made numerous trips to get our unit repaired and brought up to code, along with witnesses to my moving on the date I notified them I would do so.  

I might instead try them in the media by going to the local NBC station here in Fort Worth who has a '5 on Your Side' reporter that investigates shoddy practices by businesses that adversely affect private citizens.  Or I might do both.  At the very least, I will get my deposit back, if not much more.  It just depends on how many games Myan wants to play before crashing and burning in defeat.  If they want to play games, I have all the pieces to win so bring it on.  I am semi-patiently awaiting Sandee and Myan's response and I will keep you posted.
