LGBT Equality took a giant leap forward with yesterday's ruling from the Ninth Circuit Court of Appeals upholding Judge Walker's original ruling that Proposition 8 in California was indeed unconstitutional. The Court also ruled that there was no just cause for Judge Walker to have recused himself from the case simply because he was Gay and in a LTR with another man. You should read the excellent analysis of the ruling by Ari Ezra Waldman over at Towleroad.com for a more in depth understanding of the intricacies of the case and its ruling. The three leading candidates for the Republican nomination were quick to condemn the ruling and spew their hateful bile while most everyone else was joyous and full of praise for the ruling. Whether the defendants choose to appeal to the Ninth Circuit en banc (for all 11 of the judges to rule instead of the 3 that did) or take their appeal to the US Supreme Court remains to be seen as well as the lifting of the stay of execution of Judge Walkers original ruling. This is one giant step forward in our march toward total equality under the law and a moment to be cherished as truly historical.
